Terms and Conditions

Booking of Courses

Booking courses will be taken by email or in writing confirming all dates and the course you require. An acknowledgement email will be returned with acceptance of your course and confirmation of dates. Deposit or full payment will be required within 72 hours of booking confirmation.

Honour of trust, if you email confirmation from your personal email address we will book your course so long as payment has been agreed with the principle instructor.

Deposits

Deposits will not be refunded unless cancelled in writing eight weeks before the start of your course. After eight weeks no refund will be given. At the discretion of Imagine Sailing alternative dates maybe offered. If you cancel your course with in eight week full payment will be due.

Course Fees

All course fees are quoted in UK pounds (GBP)

The balance of fees is due six weeks before course commencement. In the event of non-payment we reserve the right to re sell the booking, any deposit will be forfeited. All cheques are to be payable to ‘Imagine sailing’ and posted to 9 Birch Fold, Goostrey, Crewe ,CW4 8NR. This is a business bank account and the mailing address represents a bonafide business address for Imagine Sailing in the UK.

Changes

Imagine Sailing reserve the right to alter any published schedule or substitution of an alternative vessel at our discretion.

Liability

Imagine Sailing shall not accept liability or claims of personal accident or personal injury .

Imagine Sailing shall not be liable at any time for claims of expenses caused by circumstances beyond its control including sickness, accident, travel delays, weather, strikes, war or civil unrest. Imagine Sailing and its employees do not accept responsibility for any loss, damage or injury suffered by persons and/or their property arising out of or during the course of their activities whilst sailing, training and/or coaching and/or instructing unless such injury loss or damage was caused by or resulted from negligence or deliberate act.

Cancellation

In the event of cancellation by the client prior to the final balance being due only the deposit is forfeited. If cancellation is after the date of final payment then the client is liable to pay the outstanding balance. At the company’s discretion we may transfer the reservation to an acceptable alternative date.

In the event of Imagine Sailing cancelling a charter or course we shall be liable only for the refund of fees paid to Imagine Sailing. No payment will be paid for incidental costs such as flights etc. For all one day courses  50% is required, the balance can be payable on the day.  Imagine Sailing reserve the right to cancel any one day course with at least 7 days notice.

Misconduct

No student or persons chartering shall bring aboard or to the training centre any contraband, drugs or other illegal substance or items. All medically prescribed medicines should be discussed with the Principle instructor prior to boarding  or attending any shore based courses.

Complaints

If you have any grievances or complaints at all you should raise them at the very first opportunity with your skipper. If you are not satisfied with the action taken you should then immediately contact the principle instructor of Imagine Sailing. In the event that you are still dissatisfied the RYA should then be contacted.

In the event a dispute is not settled by mutual agreement it is agreed that The British Law Society shall appoint an arbiter whose decision shall be final and that wherever the dispute occurred both the client and the company shall be governed by British Law.

Insurance

Imagine Sailing is fully insured and only charters vessels Safety Coded  to the British MCA code of practise.

A copy of our insurance is on board for inspection.  Further copies can be obtained on written request .

Personal Insurance

Imagine Sailing advise that personal insurance should be taken out independently when you book a course in the event of any unforeseen incident that may affect you attending a course or personal injury or cause of any third party injury or damage.

Courses

All Practical and shore based courses shall be run in connection with the RYA syllabus and course recommendations.

All instructors will be RYA accredited and will hold the appropriate qualification for the course instructed.

Own boat tuition and personally designed courses will be conducted with the full cooperation of the paying candidate.
